Process for Registration of Geographical Indications

Accepted applications are published in the Geographical Indications Journal within three months.
- Opposition to Registration
- Any person may file an opposition notice within three months (extendable by another month).
- Both parties present evidence, followed by a hearing.

Upon acceptance, the GI is registered, and the applicant receives a certificate. The registration date is backdated to the application filing date.
- Renewal
A registered GI is valid for 10 years and renewable thereafter on payment of fees.
What Indications Are Not Registrable?
Under Section 9 of the GI Act, certain indications are excluded from registration, such as:
- Indications likely to deceive or cause confusion.
- Those contrary to current laws.
- Scandalous, obscene, or offensive indications.
- Generic names or indications no longer protected in their country of origin.
- Misleading indications about the product’s true origin.
Additional Protection for Certain Goods
The Act allows additional protection for specific goods through joint applications by the GI’s registered proprietors and producers.
Affidavits and Documentation
Affidavits submitted during GI registration must adhere to strict guidelines:
- Consecutively numbered paragraphs focused on a single subject.
- Proper notarization and legal stamping are required.
- Illiterate or visually impaired deponents must have the affidavit read or explained, certified by the officer administering the oath.
Inspection of Documents
Public inspection of GI-related documents is available at the Geographical Indications Registry, Chennai. Copies may also be distributed to other locations, as directed by the Central Government.
